The Gondwana Collection Namibia Desert Grace Lodge Terms & Conditions

Included is:

4 nights for 2 adults at The Desert Grace Lodge
Dinner, Bed and Breakfast
1 x Dune drive for 2 pax (2-3hr guided drive In the Morning OR Afternoon – Discover the dunes and the many other wonders of the Namib Desert on this drive around Gondwana Namib Park. Refreshments and a light snack are included.)
1 x Desert night walk for 2 pax (short ca. 45min, guided walk – Prepare to be amazed by the sight of scorpions or other nocturnal creatures glowing in the dark under UV light.)
1 x Return transfer from The Desert Grace Lodge to Namib Sky Balloon Safaris (no other transfers/transport included)
Prize excludes flights and hotel transfers.

Validity of the prize – 01.11.2024 – 30.06.2025

YourLuxury Africa magazine, will have to provide Gondwana Collection Namibia, with the full name of the winner, as well and the email address.

Gondwana Collection Namibia will issue a voucher and send this to the winners email address.

Pre-booking is essential. No walk-in booking will be accepted at the lodge.

Booking has to be made via email and the voucher has to be provided, when making the booking.

Booking is subject to availability.

The voucher can not be used for a bookings made prior to the receipt of the voucher. (i.e. an existing booking can not be converted to make use of the voucher)

The voucher is not redeemable for cash; is non-refundable, is non-exchangeable and is non-transferable.

The voucher expires on the 30.06.2025.

There will be no refund for unused or lost voucher.

The voucher cannot be used in conjunction with any other Gondwana Collection Namibia accommodation promotion or voucher.

No preferential rates apply. This voucher is non-commissionable and is not applicable to agents or operators for retail purposes.

Over and above the aforementioned, the general Gondwana Collection Namibia T’s & C’s apply.

The winner agrees to be bound to there terms and conditions when using or attempting to use this voucher and acknowledges that he/she has read and understood the terms.

Namib Sky Balloon Safaris Terms & Conditions

Included is:

A sunrise hot air balloon safari over the Sossusvlei in the Namib-Naukluft National Park or the NamibRand Nature Reserve for two people.

I hereby agree with Namib Sky Balloon Safaris Pty (A Non-Scheduled Air Transport Service – License No. 00029) (the Operator) that when I shall be conveyed in the Operator’s vehicles and aircraft, or vehicles and aircraft facilitated by the Operator, and sustain loss or damage to my property or due to bodily harm or injury or due to my death, that I waive and abandon any claim which may arise out of such conveyance, whether or not caused by negligence of the Operators, its members, servants or directors or its subcontractors and their servants, members and directors negligence, and such waiver and abandonment being binding on my successors in law where applicable.

I further indemnify the Operator, its members, servants or directors or its subcontractors and their servants, members or directors against any claim which may be instituted by any third party for any loss or damages in the nature and arising from the causes as described in the clause above and below, and undertake to defend the Operator against any such claim and hold myself responsible for any damages awarded in such event, including costs. Notwithstanding the above, any claim which I may have or acquire against the Operator, its servants, members, directors or agents and subcontractors and their servants, members or directors, shall in any event be limited to N$300,000.00 per incident.

I further indemnify the Operator, its members, servants or directors and its subcontractors and their servants, members or directors against any claim which any child of mine or any third party may acquire against them or any one of them for such loss or damage to the extent that such claim may exceed N$300,000.00.

I agree that any claim arising out of the clauses above shall become prescribed after two years from the date on which the cause of action arose.

Where I am accompanied by any minor(s) I warrant that I am the parent or natural or legal guardian of such minor(s) and in such capacity agree on behalf of such minor(s) that any liability of the Operator, its members, servants or directors and its subcontractors and their servants, members or directors directly or indirectly caused by or arising from the reasons outlined above shall also be subject to the conditions agreed to above.

Any provision of this agreement that is held to be illegal or unenforceable may be severed and the remaining provisions hereof shall continue in force.

Any such claim or claims shall exclusively be subject to the jurisdiction of the Courts of Namibia and shall be governed by the laws of Namibia.

I acknowledge that social activities may carry the risk of infectious diseases. I further acknowledge that the Operator cannot guarantee that I will not become infected. I understand that the risk of becoming exposed to and/or infected may result from the actions, omissions, or negligence of myself and others, including, but not limited to the Operator, employees, other clients and their families. I voluntarily seek services provided by the Operator and acknowledge that I may be increasing my risk to exposure by doing so. I acknowledge that I must comply with all set company procedures to reduce the spread of infectious diseases while partaking in this activity.

I hereby grant the Operator , on behalf of myself and on behalf of my child(ren), the irrevocable right and permission to photograph and/or record me or my child(ren) while participating in the Operator’s activities and to use the photograph(s) and/or recording(s) for all purposes, including advertising and promotional purposes, in any manner and in any media now or hereafter known, in perpetuity throughout the world, without restriction. I waive any right to inspect or approve the use of any photograph(s) and/or recording(s) and acknowledge and agree that the rights granted do not require compensation of any kind. I acknowledge that the Operator may, at their discretion, utilise these videos or images for business purposes and may do so without any further express consent.

By signing this release, I attest that:

I am not aware to be pregnant, and I do not suffer from any underlying conditions that could be aggravated by partaking in this activity.
I, and/or my dependent(s) am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell and, to the best of my knowledge, I and/or my dependent(s) have not been exposed to any carrier of any infectious disease and have taken reasonable steps to avoid any such exposure.

I hereby release and agree to hold Namib Sky Balloon Safaris Pty harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of operator, or that may otherwise arise in any way in connection with any services received from Namib Sky Balloon Safaris Pty. I understand that this release discharges Namib Sky Balloon Safaris Pty from any liability or claim that I, my heirs, or any personal representatives may have against the operator with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Namib Sky Balloon Safaris Pty. This liability waiver and release extends to the operator together with all its owners, partners, and employees.
